Children's and Minors' Data

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information. However, parents and legal guardians are responsible for their children’s use of the internet and phone, and thus the company disclaims all liability for unauthorized use by minors.

·      Location information, including general geographic location such as country, state or province, or city and precise geolocation, if you have enabled and consented to location information collection.

·      Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.

·      Content and information you elect to provide as part of your profile or in any reviews you make through the Services or emails, chats, or other communications sent to us.

·      Images, voice recordings, and videos collected or stored in connection with the Services, if you have consented to such information collection.

·      Identity document information, such as Social Security and driver's license numbers, if you have consented to such information collection.

·      Any other identifying information provided as part of documents to be translated as part of the Services.

Some of the information identified above, including identification document information and precise geolocation information, may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.

We also collect:

·      Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.

·      Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

How We Collect Your Personal and Other Data Online

You Provide Information to Us

We collect information about you when you interact with our Services, such as when you place an order or make a purchase/reservation/request, or create, upload, or post content to the Services, including reviews, media such as photos, videos, or audio recordings.

From Business Partners and Service Providers

We may receive personal data about you from other sources and combine that with information we collect directly from you. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as email platform providers, content delivery services, payment processors, or promotions services. We also may receive personal data from business partners that we engage to share consumer information with us, including your personal preferences and demographic information such as age, gender, and income level so that we can better provide you with a personalized experience.

How We Collect Your Personal and Other Data Offline

This section of our privacy policy pertains to the information we collect during in-person and offline interactions, specifically for our mobile notary and translation services.

Mobile Notary Services:

During a mobile notary appointment, we collect certain information to fulfill the Company’s legal obligations and to provide you with our services. The information we collect offline is limited to what is necessary for the notarial act and for sending you a receipt. This information may include your name, address, signature, the type of document notarized, and the type of identification presented, all of which are recorded in our physical notary journal as required by law. We may also collect your email address at the time of the service to send you an electronic receipt for the payment and services rendered.

Translation Services:

When you engage our translation services, we may collect documents that contain personal information. To facilitate the translation process, we will scan or make copies of the documents you provide. These digital copies are then securely transmitted to our company's translator for processing. We do not retain physical copies of your documents.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal data, to:

·      Provide you with the Services and any contents, features, information, products, or services that we make available through the Services.

·      Fulfill and manage purchases, orders, deliveries, payments, and returns.

Your State Privacy Rights

To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. ·      Deletion. You may request that we delete personal data about you that we maintain, subject to certain exception under applicable law.  

·      Opt Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your personal data for these purposes.

Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.

As such, customers should act responsibly when transmitting their personal data. Examples of responsible measures to take to protect your personal data includes creating strong passwords, not sharing account information, and being cautious about the information sent via insecure channels like email or text messages.

Hermes Mobile Notary & Translations disclaims liability for any damages resulting from data loss, unauthorized access, or other security incidents, and such damages are limited to the fullest extent permitted by law.

How We Notify You of Data Breaches

Hermes Mobile Notary & Translations takes the security of your personal information very seriously. A data breach is defined as the unauthorized access to or acquisition of unencrypted computerized data that compromises the security, confidentiality, or integrity of personal information.

In the unlikely event of a data breach, the Company will take immediate steps to address the situation. These steps include:

1.     Containment and Assessment: We will first work to contain the breach to prevent further unauthorized access. We will then assess the nature and scope of the breach, identifying the types of personal information affected and the individuals impacted.

2.     Investigation: Our team will conduct a thorough investigation to determine the cause of the breach and to identify the vulnerabilities that led to it. We will work to remediate these vulnerabilities to prevent future incidents.

3.     Law Enforcement and Regulatory Reporting: We will notify relevant law enforcement agencies and regulatory bodies as required by law.

Notification to Affected Individuals

We are committed to notifying you promptly and transparently if your personal information has been compromised. In accordance with New Jersey law (N.J.S.A. 56:8-163) and federal regulations, we will notify all individuals affected by the data breach without unreasonable delay.

We will notify affected individuals directly via email and phone call to ensure the message is received. We will use the contact information you have provided to us. We will never ask for your personal information, like your Social Security number or bank details, in these notifications. You should be cautious of any communication that purports to be from us and asks for this kind of information.

How We Retain Your Personal Data

We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention.
